On April 21, 2009, defendant Foley was preparing to pull out of her driveway. She did not look behind her as she pulled out of her driveway and failed to see the plaintiff who was mowing her lawn and standing at the edge of the driveway. As she drove backwards, she struck the plaintiff with her vehicle causing the plaintiffs knee to catch at the height of the rear bumper. As a result to the collision the plaintiff Stevens had injuries to her knee that ultimately resulted in the need for surgery. Insurance company refused to accept reasonable responsibility for the acts of the defendant Foley and a lawsuit was filed. As trial approached, the mediation was agreed to and the case was resolved in mediation for higher than the original offer.
