KETCH Sued for Hiring Sex Offender to Work with the Handicapped
Wichita, Kansas – May 11, 2012 – Ray Hodge & Associates, L.L.C. filed a lawsuit against The Kansas Elks Training Center for the Handicapped, Inc., known locally as KETCH. The lawsuit claims that KETCH negligently hired and retained a convicted sex offender and then placed him in direct contact with individuals known to be mentally incapacitated.
The KETCH employee in question sexually assaulted a KETCH client and was ultimately convicted and sentenced to thirty-four months in prison with a lifetime post-release supervision term. He is subject to the persistent sex offender act based upon a prior conviction involving deviate sexual assault.
The lawsuit claims that prior to the sexual assault, KETCH was aware that its employee was fraternizing with the victim but failed to take measures to end the behavior. The lawsuit further claims that KETCH failed to properly investigate prior to hiring this individual and had they conducted a standard employee screening, they would have known that he was a prior sex offender.
