In some cases, such as litigating certain benefit denials or termination under an employer-sponsored plan, the Court has the power to award attorney fees. Some court’s do this routinely, while others require the insurance company to have been in “bad faith” before the will award any attorney fees. Each case and each state is different and it is best to not presume you will recover any attorney fees.
